DRIFA'S LEAP SHOP POLICIES
DEFINITIONS
1.1 "Drifa's Leap" or "Platform" means the online marketplace operated by Drifa's Leap Inc.
1.2 "Leapster" means a seller or artist who has registered to sell products on the Platform.
1.3 "Community Standards" means the set of guidelines and rules governing user behavior on the Platform.
SHOP NAME RESTRICTIONS
2.1 Prohibited Names: No shop may use Drifa, Drifa's, Driffa, Driffina, Leap, Leaping, Leapster, Leapin, Leaper, Leaped, or Leaps in their shop name.
2.2 Derivative Names: Other derivatives of these words may be restricted upon shop approval by Drifa's Leap.
LEAPSTER PROFILES
3.1 Content Requirements: Leapsters are required to create a unique profile that showcases their individual style and background, and should (but not required to) include:
(a) A brief background or biography, including if this is a co-op of artists working together.
(b) Techniques and materials used in their artwork; and
(c) Photographs of the artist at work and their workspace to provide insight into their creative process.
PRODUCT LISTINGS
4.1 Compliance: All product listings on Drifa's Leap must comply with the following guidelines:
(a) Non-infringement: Products must not infringe on any third-party intellectual property rights, including trademarks, copyrights, or patents.
(b) Accuracy: Product descriptions must accurately represent the item being sold and provide clear and comprehensive details.
(c) Legality: Leapsters are prohibited from listing any counterfeit, stolen, or illegal goods.
4.2 Leapster's Warranty: By listing a product on the Platform, the Leapster warrants that they have the legal right to sell the product and that it does not infringe upon any third-party intellectual property rights.
4.3 Platform Rights: Drifa's Leap reserves the right to remove or modify any product listings that violate these guidelines or applicable laws and regulations, without prior notice to the Leapster.
POLICING AND ENFORCEMENT
5.1 Review Process: Drifa's Leap will conduct random reviews of shops and items to ensure compliance with Community Standards and Platform policies.
5.2 Investigations: Drifa's Leap will investigate reported products or behaviors from Leapsters or buyers.
5.3 Consequences: Violations of Platform policies may result in one or more of the following actions:
(a) Warning;
(b) Temporary account suspension;
(c) Permanent account termination; or
(d) Legal action, where appropriate.
RETURN POLICY
6.1 Leapster Discretion: Each Leapster will establish their own policies regarding refunds, exchanges, and returns.
6.2 Transparency: Return policies must be clearly listed for each item, allowing for variations among different items within a shop.
6.3 Refund Processing: If a return is approved by the Leapster, the refund amount will be deducted from the Leapster's account balance. If the Leapster does not have sufficient funds to cover the refund, the amount will be added to their next billing cycle and deducted from any earnings due and owing pursuant to Section 10 below.
SHIPPING CHARGES POLICY
7.1 Fair Pricing: Leapsters are required to set their shipping charges to be about or below actual shipping costs.
7.2 No Commission: Drifa's Leap commits to not charging a commission on shipping fees.
7.3 Monitoring: Drifa's Leap will actively monitor for excessive shipping charges.
7.4 Consequences: Any Leapsters found abusing this policy will face a temporary freeze on their shop.
7.5 Free Shipping: This policy does not prevent Leapsters from offering free shipping.
DISPUTE RESOLUTION
8.1 Good Faith Negotiations: In the event of a dispute between a buyer and a Leapster, the parties must first attempt to resolve the issue through good-faith negotiations.
8.2 Mediation: If the dispute remains unresolved, the parties agree to participate in mediation conducted by a mutually agreed-upon mediator.
8.3 Arbitration: If the dispute is still not resolved after mediation, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
8.4 Platform's Role: Drifa's Leap's involvement in disputes between buyers and Leapsters is limited to facilitating communication and providing relevant transaction information. Drifa's Leap is not responsible for resolving disputes between users.
PROHIBITED ACTIVITIES
Leapsters are prohibited from engaging in any illegal, harmful, or fraudulent activities on the Drifa's Leap platform, including but not limited to:
9.1 Sale of Illegal Goods: The sale of counterfeit, stolen, or illegal goods.
9.2 Offensive Content: The posting of offensive, defamatory, or discriminatory content.
9.3 Platform Exploitation: The exploitation of vulnerabilities in the platform or attempts to gain unauthorized access.
9.4 Malicious Code: The use of the platform to distribute malware, viruses, or other harmful code.
9.5 Impersonation: The impersonation of other users or Drifa's Leap employees.
9.6 Rating Manipulation: The manipulation of product ratings or reviews.
9.7 Automated Access: The use of automated systems or bots to access or interact with the platform without Drifa's Leap's express permission.
9.8 Consequences: Drifa's Leap reserves the right to take the following actions against Leapsters who engage in prohibited activities:
(a) Immediate suspension of the Leapster's account;
(b) Permanent termination of the Leapsters's account;
(c) Removal of all associated content and listings;
(d) Forfeiture of any pending payments or credits; and
(e) Reporting of illegal activities to appropriate law enforcement agencies.
LEAPSTERS ACCOUNT AND BILLING
10.1 Commission: Drifa's Leap charges a commission of 3.5% on all sales made through the platform. Leapsters are responsible for setting their own prices, which must include the commission.
10.2 Payment Processing: Payments will be processed through our secure payment gateway.
10.3 Earnings Distribution: Leapsters will receive their earnings on the 1st and 16th of each month.
10.4 Refunds: See sections 6.3 above.
10.5 Customization: Drifa's Leap may, at its discretion, offer customized commission structures or payout frequencies to certain sellers based on their sales volume, product category, or other factors. Such customizations will be agreed upon in writing between Drifa's Leap and the seller.
PLATFORM FEATURES AND SELLER TOOLS
Drifa's Leap offers a suite of tools and resources to help Leapsters manage and grow their businesses, including:
11.1 Analytics Dashboard: Comprehensive tools to track sales, customer engagement, and other key performance indicators.
11.2 Marketing and Promotional Tools: Features to create custom listings, run sales, and reach new buyers.
11.3 Leapster Support Services: Educational resources and dedicated customer service to assist Leapsters in optimizing their Drifa's Leap presence.
INTELLECTUAL PROPERTY
12.1 Ownership: Leapsters retain ownership of their intellectual property rights in their products and listings.
12.2 License to Platform: By uploading content to Drifa's Leap, Leapsters grant the Platform a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the content for the purpose of operating and promoting the Platform.
12.3 Infringement Claims: Drifa's Leap will promptly investigate and respond to any claims of intellectual property infringement. The Platform reserves the right to remove any content that is the subject of a valid infringement claim.
12.4 Repeat Infringers: Leapsters who are found to be repeat infringers of intellectual property rights will have their accounts permanently terminated.
